Data-centre construction draws on electrical, mechanical, installation, commissioning and supervisory capability across European markets. Finding the people is only the first part. Each country brings its own employment, contractor, payroll and mobilisation requirements.

What can hold up mobilisation

A UK contract and a bank transfer do not settle the local position

Worker status, social security, right-to-work, posted-worker duties, labour-supply rules and employment costs follow the work into each country.

The position needs particular care with long-running, site-based contractors. If the project controls shifts, location, supervision and how the work is delivered, the local reality may not match the contractor label.

An unsuitable route can delay mobilisation, produce unexpected employment or social-security costs, disrupt pay and make conversion or exit harder.

What the assessment can test

Whether local employment or EOR, Contractor of Record, direct contractor engagement or payroll through an existing entity is a route worth taking forward for written provider and specialist confirmation.

The assessment identifies commercial routes and unanswered questions only. It is not confirmation that a site-based role, worker nationality, labour-supply model or provider service is available or lawful.

Route 01

Local employment / EOR

When a person may need to be an employee and the business lacks a local entity, an Employer of Record may be a route to investigate. A selected provider must confirm the country, role, worksite, employing entity and terms before any commitment.

Route 02

Contractor of Record

A Contractor of Record may be relevant only for eligible independent, non-regulated roles. Current provider rules can exclude construction, trades and site roles, so no Contractor of Record route is assumed.

Direct contractor route

Where genuine independence may be supportable, the assessment maps the direct engagement, documentation and payment questions and the triggers for a further status review. The client remains the engager unless later written terms state otherwise.

The operating position

What the Kingsway assessment does, and does not do.

Kingsway provides initial commercial scoping and a country-workforce route assessment. Under this assessment Kingsway does not employ, onboard or pay workers, process country payroll, or confirm that a provider will accept the work.

Submitting a brief does not create an employment, payroll, contractor or managed-service contract. If a route progresses, the responsible parties, scope, costs, data recipients and responsibilities are identified and agreed in writing before commitment.

Questions buyers usually ask

Before the first country assessment

Could an Employer of Record be relevant?

Potentially. An Employer of Record is one route the assessment may identify. A selected provider must confirm the country, role, worksite, employing entity and terms. Kingsway is not the legal employer.

Can existing contractors, including ZZP workers, be assessed?

Yes. The assessment can test the working facts and flag risk indicators, but it does not determine legal status. Provider assessment and local advice may be required before a contractor route is taken forward.

Who would the client contract with, and who would employ the worker?

At enquiry and assessment stage, no employment or payroll service contract is formed. If the requirement progresses, written terms identify who the client contracts with and pays, the legal employer or engager, and every operating entity. Do not assume Kingsway or a provider is the contracting party until that is agreed.

Does Kingsway confirm every country and construction role?

No. Kingsway accepts briefs for assessment, not confirmed assignments. Every country, role, nationality, worksite and supply model requires written provider confirmation before it can be offered.

How quickly could someone start?

The timetable depends on the country, possible route, role, right-to-work position, information provided and provider requirements. A start date should not be promised until the selected provider has confirmed availability and the required steps in writing.

What will the assessment say about cost?

The initial assessment identifies likely cost categories, funding questions and the information needed for pricing. No service price or funding obligation arises from this page. Any later quotation must name the contracting party and separate the relevant charges before commitment.

Why use Kingsway before speaking to a global provider?

Kingsway works through the project reality, maps different worker groups and builds one country-by-country commercial brief. That makes later provider and adviser conversations more focused and exposes unanswered questions before a route or start date is promised.

Can Kingsway assess a recruitment supply chain?

Yes. Kingsway can assess the proposed agency, end-client and worker chain and identify the availability and licensing questions. Selected providers and appropriate advisers must confirm the country-specific position.

Who would deliver a later operational service?

No provider is appointed through this page. If the requirement progresses, the written proposal must identify every contracting, employing, payroll, contractor and data-handling party, along with its responsibilities, complaints route and commercial terms.

What happens when the project ends or a worker moves country?

The assessment flags the notice, offboarding-cost and transition questions that need written answers. It does not promise continuity, a worker transfer or an available route in the next country.

Does this remove every employment, tax or supply-chain risk?

No. An employment or contractor route does not automatically remove UK PAYE or joint-liability exposure, agency rules, immigration requirements, permanent-establishment risk, licensing, site-safety duties or obligations elsewhere in the client chain. Appropriate advisers confirm matters outside Kingsway's scope.
